TERMS OF SERVICE

Agreement and business use

By buying or using a 399SiteDesign product, account, hosted site, or add-on, you agree to these terms and to the exact offer shown at purchase. You represent that you are authorized to act for the business and to provide the content, domains, profile links, and other materials you submit.

The $399 website service

The standard website offer is a flat $399 for the described three-page website package. Owner-issued discount codes are the only approved price adjustment. The current public offer describes included hosting, editing tools, launch workflow, and any separately paid domain or third-party cost. Customer-provided facts and assets remain the customer’s responsibility, and generated concepts must not be represented as real completed work.

SEO Wizard add-on

SEO Wizard is optional and separately priced. The exact price, billing cadence, activation promise, cancellation terms, and refund terms shown before purchase are incorporated into these terms and preserved with the activation record. Access begins only after independent payment verification. SEO Wizard organizes guidance, public-site checks, customer-confirmed evidence, and progress records; it does not create third-party profiles, edit the public website, buy third-party tools, or perform done-for-you SEO unless a separate written service says so.

No search or business guarantee

Search engines, map providers, social platforms, customers, competitors, and market conditions remain outside our control. We do not guarantee rankings, indexing, traffic, calls, leads, reviews, revenue, or a time-to-result. Keyword starter plans are directional unless measured data is clearly source-labeled. Customers must follow each third-party platform’s eligibility, ownership, content, and review rules.

Payments, cancellation, and refunds

Payment is due through the route and amount shown for the order. A customer’s statement that payment was sent is not proof of payment. One-time products have no automatic renewal. Any recurring or custom cadence must be disclosed explicitly and requires a new owner-confirmed handoff rather than an automatic charge. Product-specific cancellation and refund language shown at purchase controls unless applicable law requires otherwise.

Acceptable use

Do not use the service to violate law or platform policy, impersonate another business, submit material you do not have the right to use, manipulate reviews, probe private networks, introduce harmful code, interfere with other customers, or attempt unauthorized access. We may pause or end access when reasonably necessary to address misuse, security risk, nonpayment, or a material breach.

399SiteDesign text-message terms

If you expressly opt in, 399SiteDesign may send text messages related to the specific request or service disclosed at opt-in, including a requested website-preview link, service updates, and conversational replies. Message frequency varies based on your request and conversation. Message and data rates may apply. Consent to texts is optional and is not a condition of purchase.

You may reply STOP at any time to stop text messages. Reply HELP for help, or email adrian@399sitedesign.com. Carriers are not liable for delayed or undelivered messages. We may change or discontinue the text program, but an opt-out remains effective unless you later provide a new, documented opt-in.

Ownership and third-party services

You retain rights in your original business content and authorized assets. 399SiteDesign retains its software, templates, systems, brand, and reusable components. Third-party domains, search engines, business profiles, social networks, payment services, and developer tools are governed by their own terms and may change or discontinue features independently.

Service availability and liability

We work to keep the service available and accurate, but maintenance, provider outages, platform changes, and internet failures can occur. To the maximum extent permitted by law, the service is provided without warranties not expressly stated in the purchase offer, and 399SiteDesign is not liable for indirect, incidental, special, consequential, or lost-profit damages. Our aggregate liability for a claim will not exceed the amount paid for the product giving rise to that claim, except where law does not allow that limit.

Changes and governing law

We may update these terms prospectively by posting a new effective date. Stored commercial snapshots continue to evidence the product-specific terms accepted at activation. Texas law governs these terms without regard to conflict-of-law rules, except where another law must apply.
